Motion to approve the regular meeting minutes from May 5, 2014 as presented.

IV.      PUBLIC HEARINGS

  • Application for Special Exception to construct a 1,053 s.f. of additions to a residential structure including 2nd floor area, breezeway, over garage, 260 s.f. greenhouse & 1,497 s.f. pool.  330 Watrous Point Road, Map 64, Lot 17-2, Residence AA-3 District, Coastal Area Management Zone.

Robert Friedmann opened the public hearing.

Agent Jane Siris presented plans for the construction of the addition and grounds improvements.  Ms. Siris explained that the plans were not extending the existing footprint, there would be some building over the garage, a greenhouse over the deck with the addition of 1 bedroom, 2 baths and 2 closets.  The roof line would change and the owner requested deer resistant plants.

The Zoning Enforcement Officer read the motion by the site plan for recommended plantings as required by the ZBA.  Chairman Friedmann explained the purpose of such plantings.

The plans presented did not accurately demonstrate the relocation of the chimney, plantings around the northwest edge of the pool and stairs removed from the master bedroom.  Chairman Friedmann requested submission of a new drawing to replace print A-6 to accurately show as built.  Madeleine Fish further explained the need for consistency between the plans and the final build..

Motion to close the public hearing for Application for Special Exception to construct a 1,053 s.f. of additions to a residential structure including 2nd floor area, breezeway, over garage, 260 s.f. greenhouse & 1,497 s.f. pool., 330 Watrous Point Road, Map 64, Lot 17-2, Residence AA-3 District, Coastal Area Management Zone.   MADE: Robert Friedmann.  SECONDED: Geraldine Lewis. Motion to approve the Application for Special Exception to construct a 1,053 s.f. of additions to a residential structure including 2nd floor area, breezeway, over garage, 260 s.f. greenhouse & 1,497 s.f. pool.  330 Watrous Point Road, Map 64, Lot 17-2, Residence AA-3 District, Coastal Area Management Zone with the following conditions:

1)      A revised plan page A-6 must be submitted to the Zoning Enforcement Officer to illustrate revisions to the chimney relocation, plantings around the northwest edge of the pool, removal of the stairway to the master bedroom and balcony proposed at the master bedroom.

2)      All large trees between the house and the CT River must be retained.
The CAM application is approved as it is consistent with all applicable coastal policies and makes all reasonable measure to avoid adverse impacts.  MADE: Robert Friedmann.  SECONDED: Geraldine Lewis. V.        NEW BUSINESS:

  • Stipulated Agreement of Basser Kaufman & 899 Boston Post Rd, LLC.
899 & 901 Boston Post Road, B-2 District, Pedestrian Node
Agent: Attorney David Royston & Attorney Edward Cassella

Attorney David Royston requested not to continue because the stipulated agreement fell through.  Litigation is going forward.  Attorney Royston requested to remove the item off of the Agenda indefinitely.  


  • Max’s Place, LLC  request for Minor Modification to Special Exception Permit 127,600 s.f. shopping center, including 54,100 s.f. grocery store, 54,000 s.f. retail building, 8,000 s.f. liner building, 10,000 s.f. liner building, parking and landscaping.  Corner of Boston Post Road, Spencer Plain Road & Center Road West, Gateway Business B-4 District, Pedestrian Node.
     Map 25/ Lots 2, 28, 29, 30 and Map 26/Lots 6-10, 6-11, 6-12, 32, 32-1.
    Applicant: Max’s Place, LLC                   Agent:  Attorney David M. Royston

Attorney David Royston referred to his letter dated May 8, 2014, in which Max’s Place requests that condition H3 be amended to change in the completion date for the signalization and bypass lane at Center Road and signalization at Chalker Beach Road until November 1, 2014.  The work would be commenced after Labor Day.

The prior scheduled completion of said improvements is September 1, 2014.  This work will require disruption of summer traffic on the Boston Post Road is the September 1, 2014 completion date is adhered to.  The request is for some flexibility in the timeline of completion, with assurance that all work will be completed by November 1, 2014.

David Ziaks, Engineer for Max’s Place pointed out that this request will require Office of State Traffic Administration (OSTA) and DOT consent also, but advised that the Zoning Commission should decide before submitting the request to the State DOT for delay.  The work will still be bonded as required and if the delay is not approved, the work would need to proceed immediately to meet the September 1, 2014 deadline.

C.       Proposed “Mariner’s Way” section of the Plan of Conservation & Development
          “Mariner’s Way:  A Vision to Improve the Route 1 East Corridor between Saybrook Junction town center and Ferry Point marina district”
      
            The Commission held a lengthy discussion on the Route 1 Committee proposal for Mariner’s Way. Chairman Friedmann stated that the proposal was well presented and positive, presented economic improvements and expansion of mixed use zoning. Chairman Friedmann expressed that the expansion of B-3 zoning is plausible and favored.  Mr. Friedmann expressed that more discussion would be needed for B-5 and IHZ (Incentive Housing) changes.  The proposal is non-specific with no definite plan.  Concerns include taking business away from in-town areas, difficulty in developing, environmental sensitivity and design issues.

           Discussion will be continued to the next regularly scheduled meeting.

VI.     COMMITTEE, REPRESENTATIVE & STAFF REPORTS

Chairman Friedmann noted that the CT River Gateway boat trip is filled up with only room for 2 of the 4 members that expressed interest can attend. Secretary Geraldine Lewis and Colin Heffernan will attend.

        Zoning Enforcement Officer Christina Costa reported on the following topics:

  • Permitting issues with 19, 21 and 27 Bridge Street.
  • Children’s Tree Montessori School on Essex Road is proposing to expand care to 2 year olds. The Commission advised that this was within the scope of the Special Exception permit and that the school should contact the State, Fire Marshal and Building Department to determine if additional permitting is required.
VII.    ADJOURNMENT
